IN THE MATTER of an Inquiry into the conduct of

Douglas McNiven

arising from and in relation to Discipline File No. 1501-0396

NOTICE OF HEARING

TAKE NOTICE THAT pursuant to the provisions of Section 24.4 (4) of the Legal Profession Act, an Inquiry will take place by a Sole Inquirer into the following matter relating to the conduct of Douglas McNiven.

It is alleged that:
1. It is alleged that you did not adequately disclose your professional relationship with RF and RGML to TS and that such conduct is conduct deserving of discipline.

2. It is alleged that you did not have TS' informed consent to act jointly for him and for RF and RGML and that such conduct is conduct deserving of discipline.

3. It is alleged that you acted for one joint client or clients against the interests of another joint client and that such conduct is conduct deserving of discipline.

4. It is alleged that you did not competently perform the legal services you undertook and completed for your joint clients and that such conduct is conduct deserving of discipline.

5. It is alleged that you failed to promptly report to one joint client after completing legal work and that such conduct is conduct deserving of discipline.

6. It is alleged that you failed to withdraw as counsel for your joint clients when a dispute arose between them and that such conduct is conduct deserving of discipline.

7. It is alleged that you failed to disclose to your joint clients information given you by one of them and that such conduct is conduct deserving of discipline.

8. It is alleged that you advised one joint client in a dispute between the joint clients and that such conduct is conduct deserving of discipline.

9. It is alleged that you acted for one joint client against the interests of another joint client and that such conduct is conduct deserving of discipline.

10. It is alleged that you failed to answer your client's reasonable requests for information and that such conduct is conduct deserving of discipline.

The Hearing will commence at the office of the Law Society of the Northwest Territories, 4th Floor, Diamond Plaza, 5204 - 50th Avenue, Yellowknife, NT, on February 4 & 5, 2016 commencing 9:00am.
