Territorial Mobility Agreement Task Force

The TMA Task Force will be meeting next Thursday, February 18, at the boardroom of Lawson Lundell LLP (Suite 200, 4915 - 48th Street, Yellowknife).

CBA LUNCH & LEARN
How to Get Evidence Out or Keep Evidence In:
Section 24(2) of the Charter

Section 24(2) of the Canadian Charter of Rights reads: "Where, in proceedings under subsection (1), a court concludes that evidence was obtained in a manner that infringed or denied any rights or freedoms guaranteed by this Charter, the evidence shall be excluded if it is established that, having regard to all the circumstances, the admission of it in the proceedings would bring the administration of justice into disrepute."

On February 19, 2010, the Hon. Judge Schmaltz will unravel the "new" section 24(2) test introduced by the Supreme Court of Canada last summer complete with tips and thoughts on how to present a winning Charter-based argument, whether as the prosecution or defense.

Law Society Volunteer Appreciation Luncheon

The Law Society appreciates the efforts of its Committee members and other volunteers throughout the 2009/2010 Year.  As a way of expressing this, all volunteers are invited to the annual Volunteer Appreciation Luncheon.

Invitations have been emailed to all Law Society volunteers.  Any member who has experienced difficulties opening their invitation or who believes they did not receive an email invitation are encouraged to contact the Law Society office.

NWT COURTS
Increase to Territorial Court Civil Jurisdiction
 

An increase to the Territorial Court civil jurisdiction from $10,000 to $25,000 is being considered.

Increasing the civil jurisdiction would be consistent with what is happening in Western Canada, where the monetary limits in provincial and territorial courts currently range from $20,000 to $25,000.

It is expected that this change will assist the public by providing an inexpensive and efficient mechanism for resolving civil disputes up to $25,000.

Members are encouraged to forward any comments regarding this increase to Anne Mould, Director of Court Services, at anne_mould@gov.nt.ca or by phone at 920-8852.  Comments will be received until March 31, 2010.
