Renewals Members are reminded that annual membership renewal documents and
fees are due on March 31, 2010. You will find all necessary forms and information on the Law Society
website: http://www.lawsociety.nt.ca/membership/renewals.html Please note that renewal documents will not be delivered via
post. Renewal notices have been delivered via email, and all
renewal information and forms will remain on the Law Society

office. Tuesday, February 9, 2010 - 9:00am Counsel and clients must pay close attention to a variety of sources of
Canadian privacy law in the context of civil litigation. Privacy
questions arise in contemporary litigation with increasing frequency, for
example, what pre-litigation investigation techniques are reasonable under
privacy laws? What limits do privacy laws place on discovery
obligations, particularly in e-discovery? In cross-border litigation, can
personal information be disclosed to a foreign opponent in discovery? What
are the obligations that counsel and clients must adhere to when they
receive requests for access to personal information in the context of
litigation? What safeguards should be put into place? This primer on current privacy issues in civil litigation will address
all of these questions and more. Details can be found on the CBA Professional Development

Friday, February 19, 2010 - 12:00pm Section 24(2) of the Canadian Charter of Rights reads: "Where, in
proceedings under subsection (1), a court concludes that evidence was
obtained in a manner that infringed or denied any rights or freedoms
guaranteed by this Charter, the evidence shall be excluded if it is
established that, having regard to all the circumstances, the admission of
it in the proceedings would bring the administration of justice into
disrepute." On February 19, 2010, the Hon. Judge Schmaltz will unravel the "new"
section 24(2) test introduced by the Supreme Court of Canada last summer
complete with tips and thoughts on how to present a winning
Charter-based argument, whether as the prosecution or defense. Register for this Lunch &

Tuesday, February 23, 2010 - 12:00 pm The Law Society appreciates the efforts of its Committee members and
other volunteers throughout the 2009/2010 Year. As a way of
expressing this, all volunteers are invited to the annual Volunteer
Appreciation Luncheon. Save the date and look for your invitation in your inbox.
Two lists have been released that detail authorities which
the Territorial Court does not require parties to reproduce in their book
of authorities. This applies to motions, trials and summary
conviction appeals. If a party intends to rely on any of these cases, the Court requires
that the party make reference to the specific paragraphs of the judgment
to be relied on (by paragraph number) in their written argument. Those
references must be to the version of the judgment as reported in the
citation reference noted in the attached Appendices. The Appendices may be up-dated from time to time so the most recent
version of the Practice Direction must be consulted. Practice Directions from the Courts of the NWT may be found at
the following address: The Standing Committee on Social Programs, GNWT, is tasked with
conducting a review of the Child and Family Services Act.
As part of this review the Committee is holding several
contractor-facilitated workshops for stakeholders.
Friday, February 5, and Saturday, February 6, have been
scheduled for these workshops, to be held in Yellowknife. The Committee has identified several groups or organizations they would
like to hear from. The Committee feels that family law practitioners
could offer some valuable insight in the area of child welfare and
protection . Interested members are encouraged to contact: The Department of Justice of the Government of the Northwest
Territories is currently seeking feedback on a proposed Electronic
Commerce Act. Accordingly, I enclose a consultation draft of a proposed
Act, with commentary explaining the purpose and underlying principles of
the specific sections found in the legislation. This has also been posted
on the Department of Justice website at: A letter regarding this proposed Act has been received by the
Executive Director of the Law Society. Members wishing to review
this letter, along with the proposed Act, may contact the Law
